1. Acceptance of Terms

Welcome to Fragella API ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Fragella API services and website (https://api.fragella.com/). By accessing or using the API, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the API.

2. Account Registration and Access

• Eligibility: You must be at least 18 years old to create an account and use the API.
• Account Information: When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials (including your API key) and for all activities that occur under your account.
• API Key: Your API key is unique to your account and should be kept secure. You are responsible for any usage of the API key, whether authorized or unauthorized.

3. API Usage and Restrictions

3.1. License:

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Fragella API to develop, implement, and operate applications that interface with our services.

3.2. Usage Limits:

Access to the API is subject to the usage limits corresponding to your chosen subscription plan (Free, Basic, Pro, Enterprise), as detailed on our Pricing page. We reserve the right to monitor your API usage and, if you exceed the applicable limits, we may suspend or terminate your access or charge you for overages as per your plan.

3.3. Restrictions:

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the API.
• Use the API for any illegal, harmful, or unauthorized purpose, including but not limited to spamming, malware, or phishing.
• Attempt to gain unauthorized access to our systems or networks.
• Resell, sublicense, or otherwise distribute the API data directly as a standalone product.
• Use the API in a manner that disparages Fragella API or our services.
• Automate access to the API without an API key.
• Cache or store large portions of the API data in a way that would circumvent the need to access our API for fresh data, unless explicitly permitted by your subscription plan.

4. Intellectual Property

The Fragella API, its content, features, and functionality (including but not limited to data, text, graphics, logos, images, as well as the compilation thereof, and any software used on the site) are the property of Fragella API and are protected by copyright, trademark, and other intellectual property laws.

5. Disclaimer of Warranties

THE FRAGELLA API IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE API'S ACCURACY, RELIABILITY, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRAGELLA API, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR OR RELATING TO THE USE OF, OR INABILITY TO USE, THE API.

7. Indemnification

You agree to indemnify, defend, and hold harmless Fragella API, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the API, your violation of these Terms, or your infringement of any third-party rights.

8. Termination

We may terminate or suspend your access to the API immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the API will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Indiana, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our API after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the API.
